									<p>As we saw with our <a href="https://www.whitbycommunitynetwork.org/2025/09/04/whitby-maritime-facility-in-demand/" target="_blank" rel="noopener">post back in September</a>, monitoring the Town Deal &#8220;Maritime Hub&#8221;, it&#8217;s available space wasn&#8217;t being snapped up back then. </p><p>A <a href="https://edemocracy.northyorks.gov.uk/ieListDocuments.aspx?CId=1147&amp;MId=20910" target="_blank" rel="noopener">meeting in North Yorkshire Council on 26th May 2026</a> wants to approve the spending of <strong>£823k</strong> of Whitby Harbour funds &#8220;<em>the fitting out of floors one and two of the Whitby Maritime Hub&#8221;</em> and a further <strong>£126k</strong> <em>&#8220;to meet additional construction costs</em>&#8220;. So nearly a <strong>£MILLION</strong>. </p><p>This is Harbour Funds that would not exist without the <a href="https://www.whitbycommunitynetwork.org/2025/03/25/whitby-harbour-court-case-judgment/" target="_blank" rel="noopener">Fight4Whitby court case</a> where NYC were adjudged to have wrongly accounted for harbour monies over many years, so that the pier extensions could be repaired. There is no sign of the pier extensions being repaired any time soon (the draft &#8220;Harbour Strategy&#8221; had it as not starting before 2032, despite reports by internationally respected engineering experts saying that it should be <span style="text-decoration: underline;">complete</span> by then). </p><p>The item on the NYC agenda goes on to add &#8220;<em>Whitby Maritime Hub: Largely complete with tenancies secured. The cost of now fitting out the first floor is £378k with an estimate of £445k for the second floor (subject to value for money assessment), having been omitted from the original approval. The additional costs of £823k are to be met from the Whitby Harbour Reserve with the expectation that revenues generated by the Hub will be credited to the reserve to pay back the investment. A further £126k (total £354k) is required from the Whitby Harbour Reserve to meet additional construction costs in relation to supervision/management and weather-related compensation events.</em>&#8220;</p><p>Whether there will be <span style="text-decoration: underline;">any</span> revenues generated by the Maritime Hub to &#8220;credit&#8221; is the first point coming from that. The second is that any revenue generated by the Maritime Hub, which is on harbour land, would have to go in to the Whitby Harbour Reserve anyway &#8211; given that there is seemingly no available lease of the Hub from the Whitby Harbour Authority.</p>								</div>

									<p>So just 2 units on the ground floor are &#8220;under offer&#8221;. Rumour has it this is Parkol. A separate rumour is that it is at a &#8220;subsidised cost&#8221;.</p><p>If we look at that same page, we have some apparent timings to railway stations. Ruswarp takes 23 mins, Sleights 50 mins, and Grosmont 108 mins. What we can&#8217;t quite work out is what are these timings based on? Walking speed? Cycling? Driving? By train? By boat? None of these seem to align with reality. Have the property surveyor consultants visited the location? Maybe Align Surveyors, or one of those local politicians pictured at the facility can clarify?</p><p>The &#8220;community&#8221; has allegedly been invited to view the facility under construction. We haven&#8217;t yet found anyone who has received this magical invite. Do you know anyone?</p><p>Who do you think will be occupying this facility in 2026 when complete?</p><ul><li>A collection of hi tech maritime companies?</li><li>an enclosure for elephants of the white colouration?</li><li>or maybe a home for failed politicians?</li></ul><p>or maybe you have a better suggestion.</p>								</div>

									<p>We have been following the debacle with the lack of dredging in Whitby harbour for some time. Given that North Yorkshire Council (NYC) finally received a dredging licence for Whitby harbour, it was topical that a member of the public had put in an FOI asking for the current harbour sounding levels. Let&#8217;s not forget that the HarbourMaster had said they conduct regular harbour sounding surveys, so it would be good to know what situation the dredger is now facing.</p><p>In their response to the FOI, NYC asked the member of the public <em>&#8220;not to publicise the response (for navigational safety)&#8221;</em>. It has to be said that if information is obtained via the public purse and not breaching any law then it has to be divulged via an FOI. Also if &#8220;navigational safety&#8221; was the primary concern for a Harbour Authority they would</p><ul><li>not have let the dredging licence lapse in the first place, and not taken so long to get a replacement (resulting in the sounding levels currently exhibited), and</li><li>performed the necessary dive surveys on the Whitby pier extensions, at 5 yr intervals since 2012 in accordance with the advice from Royal Haskoning, and been working on a plan for the repair of these pier extensions in the intervening period.</li></ul><p>We will publicise the FOI response, with the specific note that this was the situation on 22/04/2025 and so current levels <em>&#8220;may not be the same&#8221;</em> (though they will be representative). Besides, having visibility of what to likely expect within a harbour (and with the problems widely discussed by harbour users) should be considered a good thing.</p><p>Firstly here is the lower harbour.</p>								</div>

									<p>Significant areas of major concern present in those 2 charts, but particularly in the Upper Harbour where levels very far away from the target depths. Now that a dredging licence is in place we look forward to NYC getting back to the work of a Harbour Authority and making sure that the harbour is navegable for all harbour users, and not just 2 hours outside of low tide.</p><p>You can always compare these with <a href="https://www.whitbycommunitynetwork.org/2024/11/14/whitby-harbour-soundings/" target="_blank" rel="noopener">a year earlier</a> or with <a href="https://www.whitbycommunitynetwork.org/blue-space/#dredging" target="_blank" rel="noopener">the target depths</a>.</p>								</div>

									<p>In April 2024, North Yorkshire Council were openly talking of spending <strong>£3.75m</strong> on &#8220;Fish Quay Pile replacement&#8221;. We know this because an <a href="https://www.whatdotheyknow.com/request/projected_harbour_spend_split_fo" target="_blank" rel="noopener">FOI request at the time</a> received that number in response to a query from a member of the community.</p><p>In June 2025, we are told that the Fish Quay piling work is finished. Its cost is now seemingly below <strong>£0.6m</strong>. We know that because <a href="https://www.whatdotheyknow.com/request/project_spend_on_whitby_fish_qua" target="_blank" rel="noopener">another FOI request</a> by the same member of the community has revealed it.</p><p>How was the original number so far wrong? Here are some options</p><ul><li>NYC are appalling at estimation.</li><li>NYC estimated for a complete job involving much more work, and the amount of work has been downgraded in a cost cutting measure.</li><li>Further work is planned which will make up the rest of the £3.75m.</li></ul><p>Which of those do you think is the reason?</p><p>It would be nice to hear from people who have the Fish Quay as their workplace to see if they foresee further work being needed.</p>								</div>

									<p>Dear Mr Flinton</p><p><strong>Re: Maximum 3-year lease for tenancies of the Maritime Hub on Endeavour Wharf, Whitby</strong></p><p>North Yorkshire Council is actively marketing commercial properties to let “on long leases” in the Maritime Hub, which is under construction on Endeavour Wharf in Whitby.</p><p>The Officer reports about the Maritime Hub, submitted to the NY Executive on 21st January 2025, included under legal considerations:</p><p><em>12.2 The Council owns the freehold of the site on which the Maritime Hub at Endeavour Wharf is to be located and Endeavour Wharf is also a registered cargo wharf. The proposed works to construct the Maritime Hub are consistent with the Council’s powers as a Harbour Authority and do not materially alter the wharf’s registration status. Local legislation relating to Whitby Harbour also gives the council the power to enter into lease arrangements of the units forming part of the completed development.</em></p><p>The High Court judgement issued on 14th March 2025 (Case No: QB-2021-004706) ruled that the whole of Endeavour Wharf is harbour land, including the site of the proposed Maritime Hub. Therefore, the building under construction is owned by NYC in its capacity as the Statutory Harbour Authority (SHA) for the Port of Whitby.</p><p>The local legislation relating to Whitby Harbour is the Whitby Urban District Council Act 1905, which incorporated the Harbours, Docks &amp; Piers Clauses Act 1847, including:</p><p><em>XXIII. The Undertakers may lease or grant the Use or Occupation of any Warehouses, Buildings, Wharfs, Yards, Cranes, Machines, or other Conveniences provided by them for the Purposes of this or the Special Act, at such Rents and upon such Terms and Conditions as shall be agreed upon between the Undertakers and the Persons taking the same, <strong>provided that no such Lease be granted for a longer Term than Three Years</strong>. [WCN : emphasis added]<br /></em></p><p>Since any commercial lease offered on the units in the Maritime Hub must be for no more than three years, both parties will need to agree to exclude from the lease the security of tenure provisions as set out in sections 24-28 of the Landlord and Tenant Act 1954.</p><p>We also draw to your attention that, since the site is a Zone 3b Flood Risk area, the Planning Permission for the Maritime Hub granted on 15 August 2024 (Decision No ZF24/00491/RG3) was subject to the following condition:</p><p><em>2. The development shall be carried out in accordance with the submitted Flood Risk Assessment (ref: D/I/D/152982/04 Rev 6 dated 19/03/2024), including the specified flood resilience measures, and the building shall only be used for the following:</em><br /><em>&#8211; Those uses set out in table 3.4.2 of the referenced Flood Risk Assessment; and, </em></p><p><em>&#8211; Other uses which are defined as &#8216;water compatible&#8217; by the National Planning Policy Framework December 2023 (or any future revision) and which shall be agreed in writing by the Local Planning Authority at least 90 days prior to that use commencing.</em></p><p>Fight4Whitby requests your confirmation that NYC’s marketing material will be promptly amended, in order to clearly identify these legal requirements to prospective tenants. Similarly, we request your assurance that these issues will be identified in NYC’s response to any Commercial Property Standard Enquiry form that NYC may receive and that Align Property Partners will be instructed to meet these requirements when acting on NYC’s behalf.</p><p><em>Fight4Whitby</em></p>								</div>

									<p>We refer to your letter dated 4 June 2025 raising concerns in respect of the Whitby Maritime Hub.</p><p>The Council is aware of the provisions of the Harbours, Docks and Piers Clauses Act 1847 relating to the term of leases. The Whitby Urban District Council Act 1905 incorporates the Harbours, Docks and Piers Clauses Act 1847, however, section 1 of the 1847 Act states:</p><p><em>‘This Act shall extend only to such harbours, docks, or piers as shall be authorized by any Act of Parliament hereafter to be passed which shall declare that this Act shall be incorporated therewith; and all the clauses of this Act, save so far as they shall be expressly varied or excepted by any such Act shall apply to the undertaking authorized thereby, so far as they are applicable to such undertaking, and shall, with the clauses of every other Act incorporated therewith, form part of such Act, and be construed therewith as forming one Act.’</em></p><p>The 1847 therefore applies, except in so far as it is varied or excepted. Accordingly, section 30 of the Whitby Urban District Council Act 1905 permits the Council to, inter alia, lease land on terms and conditions as they may think fit, notwithstanding anything to the contrary in any other Act. This provision permits the Council to grant leases in excess of three years.</p><p>We also note your reference to ‘water compatible’ uses as referred to in the planning permission for the Maritime Hub and can confirm we are also aware of this condition.</p>								</div>

									<p>North Yorkshire Council have been served with a pre-action protocol letter regarding the decision to go ahead with the &#8220;Maritime Hub&#8221; Town Deal project. Lawyers for <a href="http://www.fight4whitby.com">Fight4Whitby</a> sent the letter this week, in an action consequential to the winning of the long running <a href="https://www.whitbycommunitynetwork.org/2025/03/25/whitby-harbour-court-case-judgment/">Whitby Harbour court case</a>.</p><p>The land at Endeavour Wharf was ruled to be harbour land during the case which was heard in March 2024. Endeavour Wharf is a registered cargo wharf. The decision to go ahead with the building of this structure on a registered cargo wharf made no reference to s33 of the 1847 Harbours, Docks and Piers Clauses Act, and did not seek to explain how NYC would comply with s33 of the 1847 Act if part of the wharf was occupied by this structure.</p><p>Fight4Whitby have requested that NYC cease construction of the Maritime Hub in breach of s33 of the 1847 Act and make Endeavour Wharf available again &#8220;by all persons for the shipping and unshipping of goods and the embarking and landing of passengers&#8221;. Fight4Whitby have requested that NYC provide full details of what consideration they gave to s33 of the 1847 Act, as well as details of precisely what space would be available for shipping/unshipping and loading/unloading of passengers both during construction and after construction. They have until May 28th to reply, otherwise it can go to judicial review.</p><p>Excepting the (il)legality of the process, one principal reason why availability of Endeavour Wharf cargo space is essential is that to repair the pier extensions (required by 2031/2032 at the latest, from a <a href="https://www.northeastcoastalobservatory.org.uk/data/reports/25_coastal_strategy_reports/34_scarborough_borough_council/46_Whitby_(Sandsend_to_abbey_cliff)/Further%20Investigations%20at%20Whitby%20Harbour%202009.pdf" target="_blank" rel="noopener">Royal Haskoning report</a>) a site compound would be needed for storage and preparation of materials. You can see on the image below the size of the site compound likely needed (blue outline &#8211; this is the size used when repairing the west pier etc in 2018-2019). The yellow outline is the footprint of the Maritime Hub.</p>								</div>

									<p>To: Richard Flinton, <em>Chief Executive Officer</em></p><p>Cc: NYC officers, NYC Executive councillors</p><p>8th April 2025</p><p>Dear Mr Flinton</p><h4><strong>Re: Endeavour Wharf, Whitby</strong></h4><p>North Yorkshire Council (NYC) Executive Meeting Decision made on 21 January 2025 (Item 608) – approval to enter the construction contract for the Whitby Maritime Hub project on the terms principally contained in the report submitted by the Corporate Director Community Development.</p><p>Fight4Whitby requests an urgent review and reconsideration of this decision, following the High Court judgement issued on 14 March 2025 (Case No: QB-2021-004706). The Court ruled that the whole of Endeavour Wharf is harbour land, including the site of the proposed Maritime Hub. Therefore, the site is owned by NYC in its capacity as the Statutory Harbour Authority (SHA) for the Port of Whitby, not in its capacity as the Local Authority.</p><p>The NYC Executive decision taken on 21 January 2025, was made subsequent to the granting of Planning Permission for the development in August 2024. Neither of those decisions were taken after consideration of the development proposals vis-a-vis the duties and legal obligations of the Statutory Harbour Authority, despite the outstanding High Court judgement. Fight4Whitby contends that both of these decisions were unsound.</p><p>Construction work on the site should be halted immediately, pending an urgent review. Fight4Whitby submits that the NYC Executive decision taken on 21st January 2025 requires reconsideration on several grounds, including:</p><h5>a) Open Port Duty</h5><p>As the Statutory Harbour Authority, North Yorkshire Council is bound by the &#8220;Open Port Duty&#8221; established historically and under Section 33 of the Harbours, Docks, and Piers Clauses Act 1847. The Open Port Duty requires that the harbour, docks, wharves and piers shall be open to all persons for the shipping and unshipping of goods and the embarking and landing of passengers, upon payment of the appropriate ship, passenger or goods dues. The common law also imposes a duty to conserve the Harbour and maintain it for safe and accessible use as a port. Equally, its duty of reasonable care requires the Statutory Harbour Authority to ensure that the Harbour&#8217;s physical infrastructure is maintained in a safe condition for vessels.</p><p>As advertised on the current North Yorkshire Council website, the Open Port Duty applicable to Endeavour Wharf requires the availability of two NAABSA berths for vessels up to 3,000 tonnes DWT, plus the availability of at least 5,000 sq. m. of open quay storage space for cargo (plus the necessary operating space for the loading / unloading of berthed vessels; freight vehicle deliveries / collection; fork-lift truck operations, etc). In addition, UK border controls require the maintenance of a secure Customs and Excise boundary to the landward side of the wharf, together with controlled access for vehicles and pedestrians when handling passenger or cargo vessels on arrival from, or departure to, non-UK ports.</p><p>The Open Port Duty can only be removed or restricted by a Harbour Revision Order made under Section 14 of the Harbours Act 1964. Yet the reports submitted to the NYC Executive on 21 January 2025, made no reference to Open Port Duty or to the on-going requirement to maintain this duty, both during and after the construction phase of the Maritime Hub.</p><p><span style="color: #008000;"><strong>In the alternative, if building the Maritime Hub does not cause a breach of the Open Port Duty, which we are concerned it plainly does, by building on this land NYC as the SHA has sterilised the ability to carry out any major infrastructure maintenance work and/ or repairs in the future in accordance with its statutory duties to maintain the harbour.</strong></span></p><h5>b) Financial</h5><p>The High Court ruled that all income and expenditure generated by land which is owned by the Statutory Harbour Authority is to be treated as income and expenditure in respect of the harbour undertaking for the purposes of section 62 of the 1905 Act and that the Act requires a segregation of all of the capital assets and liabilities pertaining to the Harbour.</p><p>That ruling may well require significant revisions to the confidential financial report, provided to the Executive on 21 January 2025 as Appendix A – Detailed Financial implications (Private and Confidential – exempt information by virtue of paragraph(s) 3 of Part 1 of Schedule 12A of the Local Government Act 1972.)</p><p>The Council will recognise that the Decision made on 21st January 2025 has caused concern on several other grounds too, which are important to note here:</p><h5>c) Marine Planning</h5><p>The reports submitted to the NYC Executive on 21 January 2025 made no reference to UK Marine Policies and plans, nor to any consultation with the Marine Management Organisation or with the Maritime and Coastguard Agency.</p><p>This was despite the fact that, when Planning Permission for the Maritime Hub was granted in August 2024, the NPPF required:</p><p><em>183. In coastal areas, planning policies and decisions should take account of the UK Marine Policy Statement and marine plans. Integrated Coastal Zone Management should be pursued across local authority and land/sea</em><br /><em>boundaries, to ensure effective alignment of the terrestrial and marine planning regimes.</em></p><p>Prior to the meeting held on 21 January 2025, an updated version of the National Planning Policy Framework had been published on 12 December 2024, which retained S183 as above and added:</p><p><em>231. The policies in this Framework are material considerations which should be taken into account in dealing with applications from the day of its publication. Plans may also need to be revised to reflect policy changes which this Framework has made. (emphasis added)</em></p><p>Similarly, there has been concern that the reports submitted to the NYC Executive on 21 January 2025 included, under legal considerations:</p><p><em>12.2 The Council owns the freehold of the site on which the Maritime Hub at Endeavour Wharf is to be located and Endeavour Wharf is also a registered cargo wharf. The proposed works to construct the Maritime Hub are consistent with the Council’s powers as a Harbour Authority and do not materially alter the wharf’s registration status. Local legislation relating to </em><em>Whitby Harbour also gives the council the power to enter into lease arrangements of the units forming part of the completed development.</em></p><p>Fight4Whitby contends that the proposed works to construct the Maritime Hub are not consistent with the Council’s powers as the Statutory Harbour Authority. Under the Marine and Coastal Access Act 2009, the North East Marine Plan sets out specific policies to inform decision-making for any activity or development which is in, or impacts on, a marine area. The Marine Plan must be used for all planning decisions for the sea, coast, estuaries and tidal waters as well as developments that impact these areas, such as infrastructure. All public authorities are responsible for implementing the North East Marine Plan through existing regulatory and decision-making processes.</p><p>The whole of Endeavour Wharf was used for cargo handling for several decades, until Associated British Ports ceased its operations in Whitby in 2002. Although mainly utilised as a car park at present (and barring construction of the Maritime Hub) Endeavour Wharf clearly offers the potential to be reactivated for cargo<br />handling, to support the Government’s Climate Change strategies, as was noted in the Department for Transport publication Maritime 2050.</p><p>Fight4Whitby is not alone with its concerns about the correctness of the Decision made by the NYC Executive in January 2025, given the apparent failure to properly consider relevant marine legislation, policy statements and planning documents. However, in the light of the lack of consideration given to the point set out at paragraph a) above, the need to review this Decision is not only important, but must be expedited.</p><p>The Council should appreciate the significance of its apparent failure to consider the Open Port duty and the serious adverse consequences, including reputational consequences, that would flow from any breach of such a significant requirement. We require the Council to address this point specifically now. Construction work on the site should be halted immediately, pending that re-assessment.</p><p>Fight4Whitby requests the receipt of a substantive response to this letter before the next Executive Meeting is held on 15 April 2025.</p><p>Yours sincerely</p><p><em>Fight4Whitby</em></p>								</div>

									<p>The <a href="https://www.legislation.gov.uk/ukla/Edw7/5/135/pdfs/ukla_19050135_en.pdf">Whitby Urban District Council Act</a> of 1905 states that all proceeds taking place on harbour land should be ring-fenced and used for the maintenance of the harbour. It seemed that this had not been upheld since around 2004-5. Scarborough Borough Council (SBC) (now North Yorkshire Council (NYC)) questioned the extent of &#8220;harbour land&#8221;, claiming that it did not include the extensive car parks now located on reclaimed land, also that the car parks existed under the auspices of the Road Traffic Regulation Act which should take precedence over the 1905 Act (and hence not ring-fenced).</p><p>The <a href="https://www.whitbycommunitynetwork.org/blue-space/#fight4whitby" target="_blank" rel="noopener">Fight4Whitby</a> was set up, objecting to the SBC accounts, which were not signed off since 2015 as a consequence. This eventually ended up in the High Court in London in March 2024. The court needed to determine</p><ol><li>How should the 1905 Act be properly applied in these circumstances?</li><li>What is the extent of the harbour land? hence defining what revenue has been obtained on harbour land.</li><li>Does the 1905 Act require a segregation of harbour capital assets and liabilities (i.e ring fencing)?</li></ol><p>In the deliberations the disputed plots are labelled Plot 30 (Endeavour Wharf, purchased in 1928, 1937, 1938 and 1969), Plot 32 (land reclaimed from the river / Bell Shoals &#8211; registered in 1906 and reclaimed later), Plot 34 (land purchased from the British Railway Board (BRB) in 1975), Plot 33 (narrow strip of land purchased from BRB in 1981) and Plot 31 (former railway goods yard and siding purchased in 1990).</p><p>The judgment from this case was finally published in March 2025. 									<p>Justice Sweeting&#8217;s judgment includes the following</p><ul><li><strong>Whether the 1905 Act mandates a complete separation of the Harbour&#8217;s assets and liabilities, or simply requires separate accounting of income and expenditure</strong>. <em>Section 62 of the 1905 Act refers expressly to “the harbour account” and not simply a practice of separate accounting. That must, I conclude, relate to capital receipts shown in an account which reflects the harbour undertaking&#8217;s capital position and includes the value of harbour land, property, and fixed assets as well accumulated reserves allocated for the repair, replacement, or improvement of these assets.</em> See point 127 in the judgment.</li><li><strong>Whether car parking can be considered not of the Harbour.</strong> <em>I conclude that the provision of car parking on harbour land is fairly incidental to the main purposes of the Harbour and that the First Defendant is correct in submitting that all income from car parking facilities on harbour land should be credited to the separate revenue account. I therefore reject the Council’s argument that car parking revenue can be split into categories, with some considered to be received for “harbour purposes” and other revenue not.</em> See point 119 in the judgment.</li><li><strong>Whether Plots 30 (Endeavour Wharf) and 31 to 34 (reclaimed / purchased land alongside the rail line) are to be considered part of harbour land.</strong> <em>I conclude that the disputed plots are all connected to the harbour development scheme, which aimed to expand and modernise the harbour facilities. They were integral to the expansion and development of the Harbour, particularly the Upper Harbour area, with their acquisition and reclamation occurring over decades. They were acquired to facilitate various aspects of the Harbour&#8217;s operations including public access</em>. See point 174 in the judgment.</li></ul><p>Or to answer the posed questions that the court had to determine, the judge ruled as follows</p><ol><li><em>Yes, it is to be so treated. Further the provision of car parking on harbour land is fairly incidental to the main purposes of the Harbour and the First Defendant is correct in submitting that all income from car parking facilities on harbour land should be credited to the separate harbour revenue account. Revenue from lawfully exploiting a harbour asset (such as leasing land or granting a licence) is inherently harbour revenue and should be credited to the separate harbour revenue account</em>.</li><li><em>All five of the disputed plots are held for harbour purposes; that is they are part of the harbour undertaking</em>.</li><li><em>Yes, it does</em>.</li></ol>								</div>

									<p>Justice Sweeting denied NYC the right to appeal his judgment direct. The only option they now have available to challenge is to register a case with the Court of Appeal by April 8th.</p><p>Should NYC not appeal, or appeal and lose, then they will have to allocate funds from previous years starting in 2015 (when the objection was registered) into the separate Whitby Harbour account. It is understood that this will have to include monies obtained from the sale, several years ago, of the former Khyber Pass toilets (purchased and left derelict).</p>								</div>

									<p>Dear Councillors and Officers,</p><p>The NYC Forward Plan shows that, on 21 January 2025, the NY Executive is due to receive a report about the Maritime Hub on Endeavour Wharf in Whitby harbour. The report will seek Executive approval to enter into a contract with the construction contractor to deliver the agreed works, subject to a viable business case.</p><p>The agenda and reports for that Executive meeting have yet to be published, but Whitby Community Network submits that this decision should be deferred to a later meeting. This would allow time for the Council to consider the Environment Agency’s latest assessments of increased flood risks, published in December 2024. The National Planning Policy Framework was also subject to revision in December 2024. Planning decisions must incorporate climate-resilient design principles and strategies to alleviate the impact of extreme weather events.</p><p>Small, isolated coastal towns are predicted to suffer the effects of climate change more than inland areas. Whitby town and harbour lie on the only tidal estuary in North Yorkshire. The tidal waters of the River Esk extend beyond Endeavour Wharf to Ruswarp weir, which lies some 2km upriver of the harbour mouth, at the boundary with the North York Moors National Park. The tidal reaches of the Esk, together with the inner and outer harbour, are part of the North East Inshore Marine Plan area.</p><p>The North East Marine Plan sets out specific policies to inform decision-making for any activity or development which is in, or impacts on, a marine area. The Marine Plan must be used for all planning decisions for the sea, coast, estuaries and tidal waters as well as developments that impact these areas, such as infrastructure. All public authorities are responsible for implementing the North East Marine Plan through existing regulatory and decision-making processes. However, the planning application for the Maritime Hub made no reference to the NE Marine Plan and the proposed development does not appear to comply with several of its policies.</p><p>The current NYC Strategic Flood Risk Assessment (SFRA) does not include the risks from sea and tidal flooding. Neither does it consider the non-tidal length of the River Esk beyond Ruswarp, since that SFRA is the responsibility of the North York Moors National Park Authority.</p><p>Thus there is no current, accurate assessment of the combined flood risk in Whitby harbour at times of concurrent sea and river flooding. The Environment Agency claims that the new National Flood and Risk Assessment will provide a single picture of current and future flood risk from rivers, the sea and surface water.</p><p>The new flood risk forecasts and revised planning guidance on climate change are material considerations in decision-taking. We submit that it would be irrational to take an Executive decision about the Maritime Hub on 21st January, without first allowing sufficient time for consideration of the potential implications for the proposed development of Endeavour Wharf and its compliance with the NE Marine Plan.</p><p>A summary of the relevant policies and reports is attached for your consideration.</p><p>Yours sincerely</p><p><em>Whitby Community Network CIC</em></p><p>Summary of relevant policies and reports</p><p><span style="text-decoration: underline;"><strong>1. National Flood Risk Assessment and National Coastal Erosion Risk Map [<a href="https://environmentagency.blog.gov.uk/2024/12/17/transforming-our-understanding-of-flood-and-coastal-erosion-risk-in-england/">link</a>]<br /></strong></span></p><p>The Environment Agency’s new <b>National Flood Risk Assessment</b> (NaFRA) and <b>National Coastal Erosion Risk Map</b> (NCERM) were issued on 17th December 2024. Much improved local-level data will be made available from the end of January 2025.</p><p>The <a href="https://assets.publishing.service.gov.uk/media/675c362898302e574b91536e/E03253099_EA_Flood_Coastal_Erosion_Risk_Assessment_accessible.pdf">Environment Agency states</a> that:</p><ul><li>The new national assessment of flood risk (NaFRA)<ul><li>provides a single picture of current and future flood risk from rivers, the sea and surface water</li><li>uses both existing detailed local information and improved national data</li><li>includes the potential impact of climate change on flood risk</li></ul></li><li>It provides clearer detail than our current risk assessment on the areas at risk – providing much higher resolution maps that make it easier to see where there is risk.</li><li>The current Risk of Flooding from Rivers and Sea maps are limited by a 50 metre resolution. The better modelling in the new NaFRA provides a 2 metre resolution.</li><li>The new NaFRA will also be able to show characteristics such as: potential flood depths; likelihood and impacts; and the economic damages of flooding.</li></ul><p><span style="text-decoration: underline;"><strong>2. National Planning Policy Framework [<a href="https://www.gov.uk/guidance/national-planning-policy-framework">link</a>]<br /></strong></span></p><p>A new version of the National Planning Policy Framework was published on 12th December 2024 and includes:</p><ul><li><em>231. The policies in this Framework are material considerations which should be taken into account in dealing with applications from the day of its publication. Plans may also need to be revised to reflect policy changes which this Framework has made.</em></li><li><em>163. The need to mitigate and adapt to climate change should also be considered in preparing and assessing planning applications, taking into account the full range of potential climate change impacts.</em></li><li><em>183. In coastal areas, planning policies and decisions should take account of the UK Marine Policy Statement and marine plans. Integrated Coastal Zone Management should be pursued across local authority and land/sea boundaries, to ensure effective alignment of the terrestrial and marine planning regimes.</em></li></ul><p><span style="text-decoration: underline;"><strong>3. The North East Marine Plan [<a href="https://assets.publishing.service.gov.uk/media/60f6f3df8fa8f50c7450ebf1/FINAL_North_East_Marine_Plan__1_.pdf">link</a>]<br /></strong></span></p><p>The North East Marine Plan covers the English inshore and offshore waters from the Scottish border to Flamborough Head. It must be used for all planning decisions for the sea, coast, estuaries and tidal waters (which sometimes extend a long distance inland), as well as developments that impact these areas, such as infrastructure. All public authorities are responsible for implementing the North East Marine Plan through <a href="https://assets.publishing.service.gov.uk/media/673b062772f19089dfdade6a/Marine_Planning_-_A_guide_for_local_councils_Clean_Accessible.pdf">existing regulatory and decision-making processes</a>.</p><p>Please note: NE Marine Plan Policy NE-INF-2 states:</p><ul><li><em>NE-INF-2 (1) Proposals for alternative development at existing safeguarded landing facilities will not be supported.</em></li><li><em>59. Landing facilities are structures, or amenities, that enable the loading or unloading of goods, catch, freight, waste or passengers by vessels (for example, aggregate and waste wharves, slipways, jetties and piers).</em></li><li><em>60. Safeguarded landing facilities are designated sites that protect their functioning for current and future use…</em></li><li><em>&#8230; safeguarded sites across the north east inshore marine plan area include operational and viable non-operational wharves, which have the potential to be reactivated and their use maximised for waterborne freight handling.</em></li></ul><p><span style="text-decoration: underline;"><strong>3a. The Whitby Coastal Strategy 2 [<a href="https://www.northeastcoastalobservatory.org.uk/data/reports/25_coastal_strategy_reports/34_scarborough_borough_council/46_Whitby_(Sandsend_to_abbey_cliff)/Whitby%20Coastal%20Strategy%202012%20-%20Main%20Document.pdf">link</a>]<br /></strong></span></p><p>The Whitby Coastal Strategy 2 was later incorporated into the NE Inshore Marine Plan. It covered the five kilometres of North Yorkshire’s coastline between Sandsend and Whitby’s Abbey Cliff, and extended two kilometres into the River Esk estuary. The Strategy built on the original Whitby Coastal Strategy (2002); the River Tyne to Flamborough Head Shoreline Management Plan (2009); and a comprehensive suite of investigations at Whitby Harbour (undertaken 2007- 2009).</p><p>The Strategy Report 2 was adopted by SBC in 2012 and an application was made to the Environment Agency for Flood and Coastal Erosion Risk Management (FCERM) Grant-in-Aid from central government, in support of the capital costs. The whole life costs of the Strategic Plan over the entire coastal frontage over the next 100 years were estimated at £118m.</p><p>The Strategy highlighted the need to maintain the outer harbour structures (main piers and extensions) over the next 100 years since they were critical to the management of the wider coastal area [e.g.by reducing the loss of sand from Whitby beach]. But it also stressed that failure to adequately maintain both the piers and the pier extensions would risk inundation of the whole town centre and the total closure of the port. The very comprehensive report was based on extensive research and modelling and also considered the social, economic and environmental implications, for example:</p><ul><li><em>3.3.3 Within the Study Area of Whitby Coastal Strategy 2, there is great inter-connectivity of physical processes and environmental setting across the coastal frontage, the Whitby Harbour piers, and the river frontage. At the centre of these interactions is Whitby Harbour itself, which has a strategic importance within the Study Area, not only socially, economically and environmentally (especially heritage value and earth science heritage value), but also in terms of technical issues related to the physical processes that operate across the Study Area. Management decisions at Whitby Harbour can positively or negatively influence the risks, and potentially can constrain the available management options, along the adjacent coasts and within the inner harbour. For this reason a strategic approach to management of risks within the Study Area is essential.</em></li><li><em>4.2 The consequences of doing nothing are that there would be 776 properties potentially at risk from erosion or instability over the next 100 years. There would be the loss of 53 listed buildings, 68 cultural heritage sites, 21 archaeological sites, 17 Defence of Britain sites and 2 scheduled monuments. The loss of the Harbour Piers would adversely affect the geological SSSI, and 2 conservation areas. There would be loss of tourism and amenity value which is irreplaceable due to the unique tourist appeal of key cultural assets and the iconic location of the Abbey and Harbour setting. A further 159 properties are at risk from sea flooding.</em></li><li><em>5.5.9 Recognising the importance of the Study Area to the UK economy in terms of its tourism and recreational value, driven by its unique visitor product and tourist appeal, a Contingent Valuation Study was undertaken. This identified the annual economic revenue from tourism and recreation, the perceived ‘equivalent value’ enjoyed by visitors to the Study Area, and the reduction in visits should that value be adversely affected by deteriorating coastal, harbour and river defences under a Do Nothing option.</em></li><li><em>5.5.11 Further damages associated with failure of the Whitby Harbour structures under a Do Nothing option were calculated based on the importance of the ongoing functionality of the harbour to the UK economy, as defined by the loss of an important UK harbour refuge (leading to loss of life during North Sea storms), relocation of the RNLI Lifeboat Station, damage to vessels berthed in the harbour, and costs for increased dredging requirements in the harbour channel. Additional losses to harbour-related business of fishing and maritime services, as well as loss of opportunities for marine business associated with the North Sea offshore wind farm developments were considered either qualitatively or, where valid, quantitatively.</em></li></ul><p><strong>Note: Use of Endeavour Wharf</strong></p><p>The refurbishment works carried out on the main piers during 2018/19 required the use of Endeavour Wharf as the site compound for the receipt and storage of all HGV deliveries of plant and machinery, plus office and welfare facilities for the construction staff (<a href="https://planning.scarborough.gov.uk/online-applications/applicationDetails.do?activeTab=summary&amp;keyVal=P74JIJNSM2N00" target="_blank" rel="noopener">SBC Planning Decision No 18/00872/RG3 &#8211; 14 June 2018</a>). There is no road access to the East Pier and very limited HGV access to the West Pier. Materials and equipment were ferried to/from the appropriate current work sites on the piers, by vessels using the two deep-water berths at Endeavour Wharf.</p><p>The repair work could only proceed safely during the limited periods of favourable sea conditions at the harbour entrance. Rapid evacuation was needed at times, hence the need for a site compound situated within the harbour. There is no other suitable location.</p><p>Substantial repair and maintenance work on the pier extensions was scheduled for completion by 2032. But the extensions are totally inaccessible by road and are subject to more extreme sea conditions than the main piers. The East Pier extension is the most directly exposed to wave action of all the harbour structures. Major construction work on the extensions will require the extensive and prolonged use of Endeavour Wharf as the site compound. All of the construction plant and materials will need to be delivered by road to the Wharf for storage, pending timely shipment to and from the pier extensions.</p><p>The current Shoreline Management Plan identifies the need to “hold the line” in respect of the piers and extensions until the end of this century. Further repair works and the raising or strengthening of these harbour structures may well be required during that period, given the actual increase in sea-levels and extreme weather conditions experienced during the years ahead.</p><p><strong><span style="text-decoration: underline;">4. The Current NYC Strategic Flood Risk Assessment for Whitby</span></strong> <strong>[<a href="https://www.northyorks.gov.uk/environment-and-neighbourhoods/flooding/flood-and-water-management">link</a>]</strong></p><p>NYC is the Lead Local Flood Authority (LLFA) for the Whitby area, but this excludes flood risk assessment for the non-tidal length of the River Esk, which is the responsibility of the North York Moors National Park Authority LLFA.</p><p>The NYC Local Flood Risk Strategy 2022- 2027 is only required to consider flooding from ordinary watercourses, surface water and groundwater. It does not include the risk of flooding from the sea. Thus there is no current, accurate assessment of the combined flood risk in Whitby harbour at times of concurrent sea and river flooding.</p><p>Historically, the most severe flooding in Whitby occurs when extreme weather conditions across the River Esk catchment area result in flood surges down the river, into the tidal reaches, concurrent with exceptionally high incoming tides and an aggressive wave climate. There is a clear and urgent need to produce a combined flood risk assessment for Whitby harbour and the town centre under such conditions.</p>								</div>

									<p>22 January 2025</p><p>FAIR NOTICE</p><p><strong>Re: Executive Decision on 21 January 2025 to enter into a contract with the construction</strong><br /><strong>contractor to deliver the agreed works for the Maritime Hub on Endeavour Wharf, Whitby.</strong></p><p>Dear Councillors and Officers</p><p>As set out in our letter dated 12 January 2025, we maintain that this decision should have been deferred, to allow sufficient time for consideration of the potential implications for the proposed development on Endeavour Wharf of:</p><ul><li>new Environment Agency flood risk forecasts,</li><li>revised NPPF guidance on climate change,</li><li>and compliance with the NE Marine Plan.</li></ul><p>Executive approval was granted, irrespective of such considerations. However, there remains a requirement for a Full Planning Application to be submitted and approved before the whole of Endeavour Wharf car park can be closed to the public, for the duration of the construction, as stated in para. 10.3 of the report submitted yesterday to the Executive [<a href="https://edemocracy.northyorks.gov.uk/documents/s45802/250121%20-%20Report%20- %20Whitby%20Maritime%20Training%20Hub.pdf" data-wplink-url-error="true">link</a>].</p><p>This requirement for a Full Planning Application was alluded to in a footnote to our previous letter, which cited the <a href="https://planning.scarborough.gov.uk/online- applications/applicationDetails.do?activeTab=documents&amp;keyVal=P74JIJNSM2N00" data-wplink-url-error="true">SBC Planning Decision No 18/00872/RG3 of 14 June 2018</a>. 									<p>Thank you for your letter dated 22nd January 2025 in regard to the Executive Decision for the Whitby Maritime Hub.</p><p>The planning application for the Whitby Maritime Hub was determined in line with the planning policy and relevant legislation in place at the time of its consideration in August 2024. The Environment Agency (EA) were consulted throughout the planning process, and a site specific flood risk assessment provided which was assessed by the EA and their views considered.</p><p>The design of the building takes into the account it’s location in a flood zone. The Local Planning Authority have confirmed a further planning application is not needed to carry out the construction of the building on Endeavour Wharf. The facility is restricted to water compatible uses which is applicable to maritime related activities. The Executive made its decision based on the relevant information that applies to the Whitby Maritime Hub. The Town Deal Board and the Council will continue to keep the community informed throughout the build through our media outlets.</p>								</div>

									<p>Back in May (2024) <a href="https://www.whitbycommunitynetwork.org/2024/05/01/harbour-dredging-amounts-2018-2023/">we posted about the lack of dredging in Whitby Harbour</a>. In response to one of our queries, (Harbour Master) Mr Pearson replied that <em>&#8220;We conduct regular sounding surveys, so that we can monitor dredged depths and identify key target areas which need our attention. Where possible we try to maintain depths to be around 1.4m below chart datum, which cannot be guaranteed due to the occasional rapid siltation&#8221;</em>.</p><p>Mr Pearson did not provide any further details about these sounding surveys, and <a href="https://www.whatdotheyknow.com/request/whitby_harbour_sounding_survey_d" target="_blank" rel="noopener">a recent FOI</a> has managed to extract the details from NYC of these &#8220;frequent surveys&#8221;. It turns out that in the whole of 2023 and 2024, there have been just 2 sounding surveys &#8230; one of the upper harbour (Oct 2023), and one of the lower harbour (Feb 2024)! Given that the Oxford English Dictionary defines &#8220;frequent&#8221; as <em>&#8220;Happening or occurring at short intervals; often recurring; coming or happening in close succession&#8221;</em> we note that Mr Pearson has adopted the modern political practice of redefining words. Bowel movements are &#8220;frequent&#8221; (<em>or should be</em>), <strong>the sounding surveys have been anything but frequent.</strong> At just 1 sounding of the lower harbour in a 24 months timeframe (and the same in the upper harbour), that is a very extravagant description of something that is hardly ever done.</p>								</div>

									<p>With reference to where NYC will be dredging when they ever get a licence to dredge, the response says <em>&#8220;The main channel is as far as possible, maintained at a depth of 1.4m below chart datum level. A key target area is an area which falls well below the 1.4m below chart datum.</em></p><p><em>i.e. On the lower harbour survey, an area south of the Bull Noses towards the Bandstand/ Scotch Head area, the sounding falls down to 0.8m this will be a Key Target Area.&#8221;</em></p><p>Given that there seemingly have been no soundings in the last 9 months (none in the upper harbour in more than a year), and no dredging either, one has to conclude that <strong>these surveys are somewhat out of date</strong>.</p><p><strong>It begs the question does this harbour authority really have everything under control?</strong></p>								</div>
